摘要近十年来,中国生态文明建设加强了党内法规和国家法律等多元规范协同实施,形成了党规国法、法治实施、法治监督三位一体的生态文明法治体系。在习近平生态文明思想和法治思想指引下,中国生态文明法治实践有力地促进了国家环境义务从党章规范向宪法规范、法律规范的转化以及制度体系建设。其实践成效在于形成了一系列生态文明体制改革政策体系、形成了“基本法+单行法”的环境保护法律体系和相对完善的生态文明建设法治保障体系。其经验启示在于坚持生态文明建设最高位阶法源地位、党规国法协同配合、公法与私法整体性绿色化转型等方式,从而有力地促进了生态文明领域的治理体系和治理能力现代化,形成了具有中国特色的人与自然和谐共生现代化道路。 In the past decade,China's ecological civilization construction has formed a rule of law system in which internal Party regulations and national laws are implemented in coordination,and the national rule of law practice system integrating legal norms,the rule of law implementation and the rule of law supervision.Under the guidance of Xi Jinping Thought on Ecological Civilization,the practice of the rule of law in China's ecological civilization has effectively promoted the transformation of national environmental obligations from the norms of the Party Constitution to the norms of the Constitution,laws and systems.The effectiveness of the national ecological civilization rule of law lies in the formation of a series of ecological civilization system reform policy systems,the implementation of“the strictest in history”environmental protection law,and the construction of a relatively perfect ecological civilization construction guarantee system.Its experience enlightenment lies in adhering to the highest level of legal source status in the construction of ecological civilization,the coordination of Party rules and state laws,and the overall green transformation of public laws and private laws,so as to promote the modernization of the national governance system and governance capacity in the field of ecological civilization.
