摘要
习近平法治思想是在中国特色社会主义法治建设伟大实践中创立的科学理论体系,其内涵丰富、论述深刻、逻辑严密、系统完备,在概念上系统集成、在话语上自成一体、在逻辑上有机衔接。本文以学理化阐释、学术化表达、体系化构建为理论旨趣,尝试把习近平法治思想的理论体系划分为三个层次三大板块,即法治的基本原理、中国特色社会主义法治的基本理论、全面依法治国的基本观点。其中,法治的基本原理是习近平法治思想的理论基石,中国特色社会主义法治的基本理论是习近平法治思想的理论内核,全面依法治国的基本观点是习近平法治思想的理论要素。这种"三基本"的理论模型亦可作为研究习近平法治思想的一种新的学术范式。
Xi Jinping Thought on the Rule of Law is a scientific theoretical system established in China’s great practice of building socialist rule of law with Chinese characteristics.This thought is rich in content,profound in discourse,rigorous in logic and complete in system,and is integrated in concepts,self-contained in discourse and organically linked in logic.This paper,taking the theoretical interpretation,academic expression and systematic construction as the theoretical purport,attempts to divide Xi Jinping Thought on the Rule of Law into three levels and three plates.Among them,the basic principle of the rule of law,the basic theory of China’s socialist rule of law with Chinese characteristics,and the basic view of law-based governance in all respects respectively are the theoretical cornerstone,the theoretical core and the theoretical element of Xi Jinping Thought on the Rule of Law.
