摘要
习近平法治思想是中国化、时代化的马克思主义法治理论,是矗立于新时代中国特色社会主义法治实践地基上的一座高大巍峨的理论大厦,其由“全面依法治国论”“法治体系论”“法治轨道论”三个理论支柱所支撑,形成习近平法治思想最稳固的体系结构。这三个支柱是习近平法治思想中最具原创性、范式性、体系性的理论精髓。“全面依法治国论”阐明了全面依法治国作为国家治理革命、法治系统工程、法治文明新形态的三重定位。“法治体系论”阐明了中国特色社会主义法治体系在推进全面依法治国实践、完善中国特色社会主义制度、构建中国特色法治理论体系中的决定性作用。“法治轨道论”阐明了法治轨道如何明确法治的正确道路、指引中国式现代化、推进中华民族伟大复兴的重大实践问题。三者相互贯通、浑然一体,它们扎根于新时代中国特色社会主义法治实践沃土内,生成于习近平法治思想创新发展的历史脉络中,是习近平法治思想应运而生又独具匠心的时代标识。
Xi Jinping Thought on the Rule of Law is a Marxist theory of the rule of law that is modernized in China and a towering theoretical edifice standing on the foundation of the practice of socialist rule of law with Chinese characteristics in the new era.It is supported by the three theoretical pillars of the"Theory of Law-based Governance in All Aspects",the"Theory of the Rule of Law System"and the"Theory of the Path of Rule of Law",which form the most stable architecture of Xi Jinping Thought on the Rule of Law.Such three pillars are the most original,paradigmatic,and systematic theoretical essence of Xi Jinping Thought on the Rule of Law.The"Theory of Law-based Governance in All Aspects"elaborates the triple positioning of law-based governance in all aspects as a revolution in national governance,systematic engineering of the rule of law,and a new form of ruleof-law civilization.The"Theory of the Rule of Law System"clarifies the decisive role of the socialist rule of law system with Chinese characteristics in promoting the practice of law-based governance in all aspects,improving the socialist system with Chinese characteristics,and building the theoretical system of rule of law with Chinese characteristics.The"Theory of the Path of Rule of Law"expounds the major practical issues of how the path of the rule of law defines the correct way of the rule of law,guides Chinese-style modernization,and promotes the great rejuvenation of the Chinese nation.The three are interconnected and integrated.They are rooted in the fertile soil of the practice of socialist rule of law with Chinese characteristics in the new era,and generated in the historical context of the innovation and development of Xi Jinping Thought on the Rule of Law and are the sign of the era that Xi Jinping Thought on the Rule of Law is times-required and unique.
