摘要
法治中国的研究经历了从阶级范式到现代化范式再到“国家与社会”范式的演变过程。当前,“国家与社会”范式作为中国最有影响力的法治研究范式,其最为重要的贡献就是在法治话语的演变中,不仅最终确立和塑造个体化的人,而且发现了个体化的人所赖以存在的社会根基。然而,以西方“国家与社会”范式为根据的法治建构,其背后潜藏了“家国分离”的内在逻辑。“家国分离”是通过国家层面的“去家化”和个体的“离家出走”这两个层面建构法治话语,而这一话语恰恰又展现了以西方话语驱除中国家国传统和现实的逻辑。当前我国法治话语面临着诸多挑战与危机,与“家国分离”所建构的法治理论与实践紧密相关。新时代法治中国的研究,应当找回“家国”,建构法治研究的“家国”范式,处理好“家国”范式与“国家与社会”范式的关系,探求契合中国优良文化传统,面向中国当下及未来的家国关系,以此塑造中国特色的法治话语体系。
The research into the rule of law in China has gone through the process of evolution from the Class Paradigm,to the Modernization Paradigm and then to the"Country and Society"Paradigm.At present,the"Country and Society"paradigm is the most influential paradigm in China of research into the rule of law,and its most important contribution lies in the evolution of discourse of the rule of law,not only ultimately establishing and shaping individualized persons but also discovering the social basis for the existence of individualized persons.However,The construction of rule of law based on the Western-style"Country and Society"Paradigm has the internal logic of"Separation of Family and Country"in an underlying manner.The"Separation of Family and Country"is a logic to establish the discourse of the rule of law through two levels,i.e.the"De-family"at the level of the country and"Leaving Family"at the level of individual and such discourse exactly shows the logic of westernstyle discourse dispelling the Chinese tradition and practice of"family and country".At present,the discourse of rule of law is confronted with many challenges and crises in China,which is closely related to the theory and practice of the rule of law constructed on basis of"separation of family and country".For the research into the rule of law in China in the new era,it is necessary to restore the"Family and Country",construct the"Family and Country"Paradigm of research into the rule of law,properly handle the relationship between the"Family and Country"Paradigm and the"Country and Society",and explore a kind of family-country relationship that conforms to Chinese excellent tradition and embraces the present and the future of China,thus shaping the discourse system of the rule of law with Chinese characteristics.
