摘要
均衡是具有针对性、有效性、可行性的个人数字权利实现态势。个人数字权利的实现设定在三个内外纵横的立体均衡层面上:一是横向层面上个人数字权利相互之间的均衡,二是纵向层面上个人数字权利和数字义务之间的均衡,三是纵向层面上个人数字权利和数字权力之间的均衡。这三个纵横层面构成立体均衡的个人数字权利实现系统,根据系统论方法和数字权利动态发展机理,三个纵横层面的个人数字权利均衡包括整体性均衡、有序性均衡、结构优化性均衡和动态均衡,分别从“权利共处”出发确定各种个人数字权利在“量”上的合理分配比例、从“权利本位”出发确定个人数字权利和数字义务在“量”上的合理分配比例、从“权利保障”出发确定个人数字权利和数字权力在“量”上的合理分配比例,最终达到个人数字权利的主体维度均衡、内容维度均衡、空间维度均衡和时间维度均衡,在均衡中实现数字权利。
Balance is a targeted,effective and feasible state for the realization of personal digital rights.The realization of personal digital rights is set on three three-dimensional balanced levels of internal and external integration:the first is the balance among personal digital rights on the horizontal level;the second is the balance between personal digital rights and digital obligations on the vertical level;the third is the balance between personal digital rights and digital power on the vertical level.The three vertical and horizontal levels constitute a three-dimensional balanced system for the realization of individual digital rights.According to the system theory method and the dynamic development mechanism of digital rights,the balance of personal digital rights on these three vertical and horizontal levels includes overall balance,orderly balance,structural optimization balance and dynamic balance.They respectively determine the reasonable distribution ratio of various personal digital rights in terms of"quantity"from the perspective of"coexistence of rights",the reasonable distribution ratio of personal digital rights and digital obligations in terms of"quantity"from the perspective of"rights-based",and the reasonable distribution ratio of personal digital rights and digital power in terms of"quantity"from the perspective of"rights protection".Ultimately,it achieves the balance of personal digital rights in the subject dimension,content dimension,spatial dimension and temporal dimension,and realizes digital rights in the process of balance.
