摘要
数字时代的到来,为社会生活带来便利与机遇的同时,也引发了一系列风险与挑战,甚至改变了某些权利形态及其权益维护方式。数字弱势群体伴随着数字时代而产生,但在数字化生活中却面临着权益维护的诸多困境,存在身份识别困境、数字技术发展与数字权益维护的张力平衡以及数字弱势群体权益维护的责任主体模糊等问题。如何保障数字弱势群体权益,成为数字时代社会治理平等性与普惠性的突出问题。从政策与法律框架的角度出发,数字弱势群体权益维护的法治保障措施需要确认数字身份,保障数字人权;协调技术治理与法律治理的关系;以多元主体、多元方式协同推进数字弱势群体的权益保障。
The advent of the digital age has brought convenience and opportunities to social life,but it is also filled with risks and challenges,and even changed some forms of rights and the way they are protected.The emergence of the digitallydisadvantaged has accompanied the digital age,but they face many difficulties in safeguarding their rights in digital life,including identity recognition ones,the tension balance between digital technology development and digital rights maintenance,and the ambiguity of the responsible parties for safeguarding the rights of those groups.How to protect the rights and interests of such groups has become a prominent issue in the governance of the digital age,reflecting equality and inclusiveness.In terms of policy and legal framework,the legal protection measures for safeguarding the rights and interests of those groups need to confirm digital identity and safeguard digital human rights,coordinate the relationship between technological governance and legal governance,promote the protection of the rights and interests of those groups through collaborative efforts with multiple entities and methods.
