摘要
法律思维、法治思维和法理思维,分别强调了法律规范、法治秩序和思维决断的重要性,构成了较为完整的法学思维方式。传统的规范法学比较重视对法律思维的研究,政治法理学则重视对法治思维的研究。然而,两者都对与逻辑关联度较高的法理思维重视不够,以至于经常出现逻辑断裂的思维现象。推进法治建设不仅需要法律思维、法治思维,还需要法理思维。法律思维注重法律规范的作用,对法治的实施主体不够重视,属于法律决断论。法治思维虽然强调政治、治理主体的重要性,试图运用法律化解社会矛盾,但往往忽视逻辑思维规则的运用,以致很多决断不符合法理。法理思维是建立在尊重法律规范、法治秩序之上的综合决断方式,它既强调思维决策过程的法治之理,又主张对所有的法律假定和拟制使用批判思维、体系思维和反省思维,以保证决断的正当性。
Legal thinking, the thinking based on the rule of law, and the Fali thinking, respectively emphasis the importance of legal norm, legal order and the decision of thinking. They constitute a relatively complete mode of legal thinking. The traditional legal dogmatics mainly focuses on the research of legal thinking. Political jurisprudence lays more importance on the thinking based on the rule of law. However, neither takes seriously the thinking basing on Fali, which is related to logic severely, so that the phenomenon of thinking with logical break often appears. The construction of the rule of law need not only legal thinking and the thinking based on the rule of law, but need the Fali thinking which attaches more importance to logic. Legal thinking, which belongs to legal decisionism, pays less attention to the subject of the rule of law than the function of legal norms. The thinking by the rule of law, emphasizing the function of politics and the governor, tries to solve the social contradictions, but ignores the appliance of logical rules. So, many decisions based on the thinking by the rule of law don’t accord with the requirements of Fali. The Fali thinking, which respects legal norms, is a kind of comprehensive mode of decision. It speaks much of principles about the rule of law in the process of decision. In order to maintain justified decisions, it also claims that critical thinking, systematic thinking and reflective thinking be applied to all the legal presumptions and legal fictions.
