合约保护视角下闲置农房优化配置机制研究——以德阳农交所“三书模式”为例

Research on the Optimal Allocation Mechanism of Idle Rural Houses from a Contract Protection Perspective:A Case Study of the“Three Certificates Model”at Deyang Agricultural Equity Exchange

摘要 管好用活农村资源资产是健全要素保障和优化要素配置机制的客观要求,也是进一步深化农村改革、扎实推进乡村全面振兴的重要支撑。立足闲置农房交易面临“强需求”和“欠规范”的基本现实,文章从合约保护视角探究德阳农交所的“三书模式”在提升合约完备性、促进闲置农房优化配置方面的理论机制。文章构建“预备—缔约—履约”的合约完备性分析框架,从“信息对称性—合约完整性—履约稳定性”三个方面为德阳农交所“三书模式”促进农村闲置资源资本化提供理论阐释。在理论与实践的基础上,文章提出闲置农房优化配置机制的三个核心要件:规范合约全过程的合约保护机制、协同合约多主体的合约支持机制、降低合约成本的合约服务可得机制。“三书模式”为盘活利用闲置农房提供了可复制推广的经验,对规范农房合约范本、增强范本法律效能及建立健全政府支持下的市场化运营平台具有重要的政策启示意义。 Effective management and utilization of rural resource assets are essential for improving factor guarantee mechanisms and optimizing resource allocation,and serve as a crucial support for deepening rural reforms and advancing comprehensive rural revitalization.Based on the practical realities of“strong demand”and“lack of standardization”in transactions of idle rural hou-ses,this paper explores,from the perspective of contract protection,the theoretical mechanisms through which Deyang Agricul-tural Equity Exchange's“Three Certificates Model”enhances contract completeness and promotes the optimal allocation of idle ru-ral housing.We develop an analytical framework of contract completeness structured around three stages-preparation,contrac-ting,and performance-and provide a theoretical explanation of how the“Three Certificates Model”promotes capitalization of idle rural resources through the pathways of information symmetry,contract integrity,and performance stability.Combining theory with practice,this study proposes three core mechanisms for optimizing idle rural house allocation:a contract protection mecha-nism standardizing the entire contract process;a contract support mechanism facilitating coordination among multiple contract par-ties;and a contract service availability mechanism reducing transaction costs.The“Three Certificates Model”offers replicable and scalable grassroots experience in revitalizing idle rural housing,with important policy implications for standardizing rural housing contract templates,strengthening their legal effectiveness,and establishing government-supported market-oriented op-erational platforms.
