摘要倾斜保护原则,发轫于劳动法中从“身份”到“契约”的逆转,以克服契约所体现的“形式平等”。将倾斜保护原则植入数字弱势群体权利保障,具有充分的正当性。数字弱势群体倾斜保护原则的逻辑起点是数字人权保障,核心功能是矫正数字不平等,有助于实现数字法治领域的良法善治。数字弱势群体倾斜保护原则与人本主义的技术转向相契合、与数字正义的价值目标相一致,与利益均衡的调整方法相共通。就数字弱势群体倾斜保护原则的具体构造而言,主要是针对“显性”数字弱势群体与“隐性”数字弱势群体,以社会连带、分配正义与社会平等为“倾斜”之内涵,完善并优化数字弱势群体倾斜保护的实体规范与程序规范,以实现数字实质正义,推动技术善治。 The principle of tilted protection originated from the reversal of“identity”to“contract”in labor law,in order to overcome the“formal equality”reflected in contracts.Incorporating the principle of biased protection into the protection of the rights of digital vulnerable groups has sufficient legitimacy.The logical starting point of the principle of biased protection for digital vulnerable groups is the protection of digital human rights,with the core function of correcting digital inequality and helping to achieve good law and governance in the field of digital rule of law.The principle of inclined protection for digital vulnerable groups is consistent with the technological shift of humanism,the value goals of digital justice,and the adjustment methods of interest balance.In terms of the specific construction of the principle of inclined protection for digital vulnerable groups,it mainly targets the“explicit”and“implicit”digital vulnerable groups,with the connotation of“inclined”being social solidarity,distributive justice,and social equality,to improve and optimize the substantive and procedural norms of inclined protection for digital vulnerable groups,in order to achieve digital substantive justice and promote technological good governance.
