摘要
立足中国式现代化,未成年人检察的叙事本质,充分体现检察制度的鲜明特色,聚焦未成年人检察业务实际的动态发展过程或阶段性结果状态,具象为理念、体系、机制、能力的全面发展。未成年人检察的叙事特质,表现为党的绝对领导,融贯的规范体系,基本理念与原则的现实化,依法定职权履职以及履职范式的专业化、规范化、社会化、智能化。现代化进程中,未成年人检察充分发挥了引领性、预防性以及促进性法治效应。未成年人检察依托于生动的检察实践与具体的制度展开,以检察机构专业化改革为轨迹,遵循诞生与探索发展、机构体系化设置与初步形成、向中国特色未检转型的历史叙事逻辑。在现代化叙事框架内,以问题为导向,透过内生式的中国本土因素分析视野,未成年人检察尚有问题有待解决。未成年人检察建设必须融贯协调规范体系,深化落实基本理念与原则,积极探索平衡发展路径,持续推动专业化、规范化与社会支持体系建设,建立健全与社会福利体系的衔接机制,统筹发展数字化赋能检察事业,最终服务保障中国式现代化的伟大征程。
The narrative essence of juvenile justice procuratorate underscores the distinct features of the procuratorial system by capturing the progressive stages and evolving outcomes of juvenile cases,embodied in the development of concepts,systems,mechanisms,and capacities.This narrative is characterized by the Party’s absolute leadership,regulatory coherence,practical application of core principles,exercising duties by legal authority,and the professionalization,standardization,socialization,and digitalization of procuratorial practices.Throughout modernization,juvenile justice procuratorate has displayed a leading,preventive,and facilitative legal role,grounded in active procuratorial practice and institutional development.Following a historical trajectory from inception and exploratory growth to institutionalization and chinese characteristics,juvenile procuratorate remains focused on resolving ongoing challenges through a problem-oriented,domesticallyinformed perspective.Looking forward,it must further integrate regulatory coherence,deepen core principles,pursue balanced progress,and enhance professional and social support systems,fostering alignment with social welfare mechanisms,digital empowerment,and sustainable support for China’s modernization path.
