摘要
数字时代,平台势力日益强大的同时也更容易引发权力滥用和失范风险,对平台自我治理的治理是基于平台自治权产生的一个新命题。除传统的封禁账号、删除内容外,在算法等技术的加持下,平台内容审查还体现为通过“引流”或“限流”等手段影响在线信息内容“被看见”的机会和范围。平台管理内容可见性日益成为平台内容审查的重要形式,虽然利用平台进行内容可见性管理有助于降低监管成本、提高监管效率,但是在私利性的驱动下,平台过分追逐商业利益而未兼顾公平、侵蚀用户权利的风险已经凸显。因而需要确定平台管理内容可见性权力行使的正当程序,建立区隔公私法审查义务的内容标准,保障用户发布内容“被看见”权利的实现,以此对平台管理内容可见性权力进行有效规制,促进数字时代社会整体福祉的提升。
In the digital age,while the power of platforms is increasingly dominant,it also becomes easier to trigger risks of power abuse and misconduct.Governing platform self-governance is a new proposition derived from the autonomy of platforms.In addition to traditional measures such as account banning and content deletion,with the support of algorithms and other technologies,platform content moderation also manifests as manipulation of the visibility of online information through methods like“promotion”or“restriction”.The management of online content visibility is becoming an increasingly important form of content moderation on platforms,which is a neglected gray area.While utilizing platforms for content moderation helps reduce regulatory costs and improve regulatory efficiency,the risk of platforms excessively pursuing commercial interests at the expense of fairness and eroding user rights has become apparent.Therefore,it is necessary to establish legitimate procedures for the exercise of platform content moderation powers,establish content moderation standards that differentiate between public and private law scrutiny obligations,safeguard the realization of users’rights to have their content“seen”,and effectively regulate platform content moderation powers to promote the overall well-being of society in the digital age.
