摘要
法治国家形象的树立和巩固有利于中国应对世界变局。党的二十大报告中关于讲好中国故事的要求与全面依法治国的要求相互呼应、彼此生发,指引着涉外法治话语体系构建和世界表达的方向。为提升中国法治国家的形象和声誉,需要将中国的观念立场和实践通过涉外法治话语推向世界,增进世界公众和舆论对于中国的理解和支持。中国涉外法治话语体系构建已经积累了相当的历史经验,取得了相当可观的成就,但也依然存在着一系列问题,其中较为明显的是:国家涉外法治话语与理论、实践的融合尚待深化;战术应对明显,战略规划偏弱;存在两种对待外来理论与制度资源的极端立场;重点领域学术研究指向有待明晰。未来涉外法治话语体系的完善,有待站在兼容并包、统一战线的高度,通过树立并坚持正确的思想观念,弥合实践与理论、实践与话语之间的鸿沟,加强涉外法治话语的理论研究,加快培养高素质的涉外法治人才等方面予以推进。
The establishment and consolidation of the image of a country ruled by law is conducive to China's response to structural changes in the world.The requirements of narrating China's stories better and comprehensive law-based governance in the report of the 20th National Congress of the Communist Party of China echo with and develop each other,showing the orientation of constructing a discourse system concerning foreign-related rule of law and its global expression.In order to enhance the image and reputation of China as a country advancing rule of law,China's concept,stance and practice require appropriate expression to the world through discourse concerning foreign-related rule of law with a view to enhancing the understanding and support of the world public and public opinion for China.The construction of China's discourse system concerning foreign-related rule of law has accumulated considerable historical experience and achieved considerable achievements,but there are still a series of problems.Among them,it is more obvious that the integration of discourse concerning foreign-related rule of law with theory and practice still needs to be deepened;the tactical response is prominent,and the strategic planning is weak;there are two extreme positions towards foreign theoretical and institutional resources;the orientation of the study remains to be clarified.The improvement of foreign-related rule of law discourse in the future requires standing at the height of inclusiveness and unity,by establishing and adhering to correct ideological concepts,bridging the gap between practice and theory,practice and discourse,strengthening theoretical research on foreign legal discourse,and accelerating the cultivation of high-quality foreign legal talents.
