摘要
情感计算应用已经成为人工智能与教育领域的交叉研究热点,在为教育的个性化、智能化提升带来全新可能的同时,也呈现出技术的依赖性、权利的侵入性和地位的关键性三大特征。在此特征下,教育场景中对情感计算的乐观应用极有可能产生“反噬效应”:诱发底层应用的技术风险;引发人格权与受教育权的保护危机;弱化教育场景中“人”的主体地位,偏离教育求真的终极目的。鉴于法律具有预防风险的天然要求,可以通过对法律规则的完善、对法律关系内容的明确以及对法律原则的设立实现对不同层次风险的回应与规制,进而促进情感计算在教育场景中的理性应用。
The application of affective computing has become a cross-disciplinary research hotspot in the field of artificial intelligence and education.While bringing new possibilities for the personalization and intelligent improvement of education,it also presents the key characteristics of technology dependence,infringement of rights and crucial status.Under this feature,the optimistic application of affective computing in educational scenarios is likely to have a"backlash effect":inducing technical risks in underlying applications;triggering a crisis in the protection of personality rights and the right to education;weakening human's subjectivity in educational scenarios and deviating from the ultimate goal of education.In view of the natural requirements of the law to prevent risks,the rational application of affective computing in educational scenarios can be promoted through the improvement of legal rules,the clarification of legal relationship content,and the establishment of legal principles so as to respond to and regulate risks at different levels.
