摘要
受教育权是我国宪法规定的公民基本权利,国家对其负有尊重、保护和实现的义务。作为基本权利,受教育权不仅是一项个体的权利,也对国家公权力具有价值约束功能,是我国发展教育事业的根本出发点。新时代以来,受教育权不仅在外延上从学校教育向家庭和社会教育扩展,而且在内涵上从获得教育机会逐渐向获得优质教育转变。受教育权的历史性发展对国家提出了"完善体系"和"提高质量"的时代要求,是建设高质量教育体系的内在逻辑动因。应据此完善教育立法,为建设高质量教育体系提供全面的法治保障,更好实现公民的受教育权。
Right to education is provided by the Constitution as citizens’fundamental right,to which state is obligated to respect,protect and realize.As a fundamental right,right to education is not only right for individual person,but also is functioning as value restraints on state’s public authority.It is thus considered the essential starting point to develop education.Since the new era,right to education has extended in its denotation from school education to family education and society education.It has also extended in the connotation from access to education opportunity to access to quality education.Historical development of right to education has proposed demands for the time on improving both system and quality,which constitute the internal logical motivation to develop high quality education system.It is required hereby to improve education legislation for comprehensive legal guarantee system supporting high quality education system development,which will better safeguard citizens’right to education.
