摘要
面对新型网络犯罪的组织化调控危机,促进“社会长期稳定奇迹”在数字社会延续发展成为犯罪治理转型的目标。在国家能力的分析框架下,本文认为“基于平台的治理”从技术、组织、制度上为犯罪治理提供转型路径,包括基于超大平台的治理和基于综治平台的治理。两类治理蕴涵着以数据控制为手段的技术安排、以社会整合为目标的组织安排和以预防型法为依托的制度安排,其兴起源于“技术→组织→制度”三元逻辑传导的建构路径,形塑出“数字科层”体系。平台治理转型的意义不仅限于以“通过平台的治理”回应治理能力危机,更在于以“针对平台的治理”趋向良法善治和回归价值理性。
In the face of the organizational and regulatory crisis of new cybercrime,promoting the continuation of the“miracle of long-term social stability”in the digital society has become a transformational goal of crime governance.Under the framework of state capacity analysis,“platform-based governance”provides transformation paths in terms of technology,organization,and system,including governance based on mega-platforms and governance based on comprehensive governance platforms.These two types of governance include technical arrangements with data control as a means,organizational arrangements with social integration as a goal,and institutional arrangements based on preventive laws,which emerge from the construction path of“technology→organization→system”and shape the“digital bureaucracy”system.The significance of the transformation of platform governance is not only limited to the transformation of the system of“digital science and technology”.The significance of the transformation of platform governance is not only limited to responding to the crisis of governance ability by“governance through platform”,but also to the return to good law and good governance and value rationality by“governance for platform”.
