摘要
创新发展中国特色社会主义法治理论,就需要对这个理论进行体系化的建构。中国特色社会主义法治理论作为一个体系化的理论,是以中国特色社会主义法治作为轴心而形成的理论体系。这个理论体系应当包括中国特色社会主义法治的指导思想、演进历程、外部关系、内在结构。准确理解、严格遵循中国特色社会主义法治的指导思想,可以确保中国特色社会主义法治在正确的方向与道路上前行。全面回顾、科学总结中国特色社会主义法治的演进历程,可以展示中国特色社会主义法治从萌生一直到成熟的生命轨迹。在中国特色社会主义的框架下把握中国特色社会主义法治的外部关系,有助于理解中国特色社会主义法治与其他现象之间的辩证关系。在中国特色社会主义法治的框架下把握中国特色社会主义法治的内在结构,有助于厘清中国特色社会主义法治体系内部的理论与实践。从以上四个方面关注中国特色社会主义法治,可以形成关于中国特色社会主义法治的四个方面的理论。把这四个方面的理论板块融为一体,可以形成关于中国特色社会主义法治的理论体系,亦即中国特色社会主义法治理论的体系。
To innovate and develop the theory of socialist rule of law with Chinese characteristics,we need to systematically construct this theory.As a systematic theory,the theory of socialist rule of law with Chinese characteristics is a theoretical system formed with the socialist rule of law with Chinese characteristics as the axis.This theoretical system should include the guiding ideology,evolution process,external relations and internal structure of the socialist rule of law with Chinese characteristics.Accurately understanding and strictly following the guiding ideology of the socialist rule of law with Chinese characteristics can ensure that the socialist rule of law with Chinese characteristics moves forward in the right direction and road.A comprehensive review and scientific summary of the evolution of the socialist rule of law with Chinese characteristics can show the life track of the socialist rule of law with Chinese characteristics from initiation to maturity.Under the framework of socialism with Chinese characteristics,grasping the external relationship of socialist rule of law with Chinese characteristics will help to understand the dialectical relationship between socialist rule of law with Chinese characteristics and other phenomena.Under the framework of socialist rule of law with Chinese characteristics,grasping the internal structure of socialist rule of law with Chinese characteristics will help to clarify the internal theory and practice of socialist rule of law system with Chinese characteristics.Paying attention to the socialist rule of law with Chinese characteristics from the above four aspects can form a theory on the four aspects of the socialist rule of law with Chinese characteristics.Integrating these four theoretical plates can form a theoretical system of socialist rule of law with Chinese characteristics,that is,the system of socialist rule of law theory with Chinese characteristics.
