摘要
在功能主义的立法思路下,土地经营权的来源和存在形态具有多样性,需要在体系化的背景下理解和适用。区分土地经营权的形成与流转,明确土地经营权的形成过程是准确认识和理解《民法典》中土地经营权规范含义的关键。权利分置是三权分置语境下土地经营权的基本特征和根本标志。立法上的土地经营权是一个集合性、框架性概念,形式上应认可土地经营权的多样性,实质上应以法律结构的差异确定土地经营权的性质。土地经营权的内容主要包括基本权利和特定请求权两大类,土地经营权的流转方式主要有转让、入股、抵押、继承等。
Under the legislative thinking of functionalism,the sources and forms of Rural land management right are diverse,which need to be understood and applied in the context of systematization.To distinguish the formation and circulation of Rural land management right and to clarify the formation process of Rural land management right is the key to accurately understand and understand the normative meaning of Rural land management right in the Civil Code."Three-Rights separation"is the basic feature and symbol of Rural land management right in the context of"Rights separation".Rural land management right in legislation is a collective and frame concept.In form,it should recognize the diversity of Rural land management right.In essence,it should determine the nature of Rural land management right according to the difference of legal structure.The content of Rural land management right mainly includes two categories:basic rights and specific claim rights.The circulation ways of land management right mainly include transfer,equity,mortgage,inheritance and so on.
