摘要
无地农民发展权问题越来越成为社会关注的热点问题。无地农民发展权是指集体组织内享有成员权但没有分配到家庭承包地的农民所享有的基本权利。无地农民发展权制度建设的价值取向为机会平等、规则平等、结果平等。其具体制度设计包括两个层面:一是公法层面,构建无地农民发展权的社会保障制度;二是私法层面,完善无地农民发展权物权法保障制度。
The issue of the right to development of landless peasants has incre-asingly become important issue of social concern.The right to development of landless peasants refers to the basic rights enjoyed by farmers who enjoy me-mbership rights within collective organizations but are not allocated to land contracted by households.The value orientation of the construction of landless peasants’right to development system is equal opportunity,equality of rules,and equality of results.Its specific system design includes two levels:one is the public law level,the construction of a social security system for the develop-ment rights of landless peasants,and the other is the private law level,impro-ving the property law guarantee system for the development rights of landless farmers.
