摘要
在农村土地"三权分置"中,土地承包权并不等同于土地承包经营权,土地承包权是土地承包经营权的产生前提,土地承包经营权是土地承包权的实现结果。对农村土地"三权分置"的合理制度架构应该是"集体土地所有权、土地承包经营权、土地经营权",并将土地经营权界定为用益物权。新修订的《农村土地承包法》对农村土地"三权分置"的权属构建并不十分清晰,《民法典》通过后,相关的争议并没有完全消除。在日后的法律修正中,应该对存在的问题进行进一步的立法完善,从而助力农村土地"三权分置"的顺利推进。
In the system for separating the ownership rights,contract rights,and management rights for contracted rural land,the contract rights are not equivalent to the contract and management rights.The former is the premise of the latter;the latter the realization of the former.The sound institutional framework for the"separation of three rights"for rural land should cover"ownership rights for collective land,land contract and management rights,and land management rights",and this land management rights should be defined as usufruct rights.The newly revised"Law on Land Contract in Rural Areas"fails to define clearly the scope of the three rights and the disputes have not been solved in the newly adopted Civil Code.Therefore,it is proposed that further legislative improvements should be made accordingly so as to advance smoothly the reform of the rural land system for separating the three rights.
