摘要
立足中国式现代化,聚焦推进国家治理体系和治理能力现代化,新时代中国法典化在方法论上应当实现自主化、效能化、集成化、协同化、数字化和动态化。自主化体现为,基于全面建设社会主义现代化国家的时代语境,新时代中国法典化应以国家治理为知识范式,自主规划和实施法典化工程。效能化意味着,法典化不仅能够统一法律适用,强化法律制度供给,还能够完善法治体系,增强国家治理合法性。集成化体现为,法典化作为一种治理技术,是对各种治理规范和治理理念的系统集成。协同化意味着,法典化要求国家治理体系中各系统、各机构更为广泛、更为深入、更高层次地参与国家立法。数字化体现为,通过运用数字技术进行法典编纂,法典的可及性和立法技术的信息化程度得以增强。动态化意味着,法典化作为一种制度变迁方式,呈现了制度从低阶向高阶、从试验向固化、从短期激励向长期激励的演化过程。
Based on the Chinese path to modernization,focusing on the modernization of China’s governance system and capacity,the methodology of codification in China for a New Era should be autonomous,effective,integrated,collaborative,digital,and dynamic.Autonomy means that,based on the era context of building a socialist modern country in an all-round way,codification should take national governance as the knowledge paradigm and independently plan and implement the codification project.Effectiveness means that codification not only unifies the application of laws and strengthens the supply of legal systems,but also improves the rule of law system and enhances the legitimacy of national governance.Integration means that codification as a governance technique is a systematic integration of various governance norms and ideas.Cooperativity means that codification requires a broader,deeper,and higher level of participation in legislation by all systems and institutions of national governance.Digitization means that with digital technology for codification,the accessibility of code and the informatization of legislative technology are enhanced.Dynamization means that codification,as a form of institutional transformation,presents the evolutionary process from lower to higher order,from experimentation to solidification,and from short-term to long-term incentives.
