摘要
改革开放至今,我国环境监管领域的一系列制度装置可以归纳为"督政"与"简政"两条平行渐进的线索,呈现出"干预主义"和"放松规制"两种倾向的竞合。从分析上述监管工具制度外观入手,可以发现上述两种倾向在实际运行中呈现出"政府监管与自我监管"、"惩戒威慑与协商激励"以及"经济发展与环境保护"的功能叠加。在此基础上讨论"中国式"制度更新所呈现的反应性与建设性共存、延续性与创新性融合,以及工具理性和目标理性独立的"稳健性"特质,将为理解中国特色的治理模式提供基于制度更新的观察视角。
China has witnessed continual institutional changes of environmental regulation since recent few decades.The paper discovers parallel yet coordinated dynamics of interventionism and deregulation and its unique rationality in the practice of environmental governance in China.The paper describes it as"parallel gradualism",a progress with dynamic equilibrium between government-supervision and self-regulation,deterrence and incentive,as well as economic and environmental values.Furthermore,the paper analyzes the logic in the Chinese-style institutional evolution for a better understanding of the adaptiveness,resilience and pragmatism methodology,which are widely discovered in the governing practice and institutional changes of contemporary China.
