摘要
附条件不起诉的适用,能够在缓解司法资源紧张和有效规制醉驾行为之间达到平衡。"法益恢复"的出罪理由、"宽严相济"的刑事政策和司法资源的优化配置是醉驾案件适用附条件不起诉的依据。结合十省份司法机关对于处理醉驾案件的规定及相关的司法实践,醉驾案件适用附条件不起诉具有合理性与可行性。对于客观行为性质不恶劣,社会危害性不大,再犯可能性较小的醉驾行为人,可以对其适用"附条件不起诉"制度。
The application of conditioned non-prosecution can help to strike a balance between alleviating the shortage of judicial resources and restricting the offense of drunken driving.The convicting reason of"restoration of legal rights",the criminal policy of"tempering justice with mercy"and the optimized allocation of judicial resources tend to be the basis for the application of conditioned non-prosecution in the cases of drunken driving.In view of the provisions promulgated by judicial authorities in ten provinces on settlement of drunk driving cases and the related judicial practice,there are rationality and feasibility to apply conditioned non-prosecution in these cases.The conditioned non-prosecution is applicable to those who have committed drunken driving yet with little malice or social harm and are less likely to commit the offense again.
