摘要
党的十八大以来,中国特色社会主义进入新时代。统计分析表明,中国的犯罪治理也迈入了崭新的时代。犯罪治理形势总体向好,犯罪内部结构发生明显变化。宏观层面,犯罪现象整体呈现数量、质量“双降”的特点;中观层面,财产犯罪仍是主要的犯罪类型,但数量和占比出现下降趋势,侵犯公共法益犯罪突出,危害公共安全和妨害社会管理秩序类犯罪占比较大;微观层面,刑事案件主要罪名的排行也有相应变化,危险驾驶罪案件数量居于首位,财产犯罪中盗窃犯罪减少而诈骗犯罪增加。当前社会治安形势整体向好,这既是加强社会治理的成果体现,也是工业化转型进入相对成熟阶段的标志。同时,犯罪的网络化、链条化、组织化特点显现,表明信息化对犯罪手段、形式、领域产生了重要影响。犯罪形势的变化必然要求相应调整我国犯罪治理的战略战术,改进刑事政策,完善刑事立法。
Since the 18th National Congress of the CPC,socialism with Chinese characteristics has entered a new era.In the meantime,statistical analysis shows that China′s crime governance has also entered a new era.The overall crime governance situation is improving,and the internal structure of crime has changed significantly.At the macro level,the crime phenomenon is characterized by a"double decrease"in both quantity and quality aspects.At the meso level,property crimes is still the main type of crimes,but there is a decreasing trend in the number and proportion.Crimes against public interests are prominent,among which crimes against public security and social order account for a large proportion.At the micro level,the ranking of major criminal cases has also changed accordingly,such as the dangerous driving cases topping the list,and theft crimes decreasing while fraud crimes increasing among property crimes.The current social security situation has turned better,reflecting the results of strengthening social governance,which is also a sign that the industrial transformation has entered a relatively mature stage.At the same time,the networked,chain cooperative,and organized features of crime have emerged,indicating that information technology has had an important impact on the means,forms,and areas of crime.The changes in the crime situation inevitably require corresponding adjustments to the strategies and tactics of crime governance,improving criminal policies and perfecting criminal legislation in China.
