摘要
轻罪在犯罪结构中占比过重,带来涉罪人数激增。为有效控制犯罪圈,减少轻罪刑罚适用,降低刑罚负面效应,当前司法呼吁实现部分轻罪出罪化处置。为此,应当重视刑罚替代措施,加强行刑衔接,以行政处罚衔接、替代刑事处罚,分流部分轻罪行为,实现轻罪犯罪圈的适当收缩。针对实践中行刑反向衔接存在的观念重视不够、检察环节过滤功能发挥不足、配套保障机制措施不力、法律规定不明等问题,促进行刑衔接实现轻罪出罪,需要更新刑事司法理念,重视行刑反向衔接;更加重视检察环节准确运用自由裁量权,扩大轻罪行为相对不起诉范围;加强配套机制制度构建,既促进不起诉的运用,又有效实现行政处罚的高效透明,确保行刑衔接渠道畅通,进而优化轻罪治理模式。
The proportion of misdemeanors in the criminal structure is too high,resulting in a sharp increase in the number of people involved in crimes.In order to effectively control the crime circle,reduce the application of misdemeanor punishment and reduce the negative effects of punishment,we should realize the criminalization of some misdemeanors.On the premise that the legislation has not been amended,to realize the criminalization of misdemeanors through judicial channels,we should pay attention to the alternative measures of punishment,strengthen the connection of execution,and substitute administrative punishment for criminal punishment.To this end,we need to update the criminal justice concept,pay more attention to the application of the criminal justice policy of"less arrest,more prosecution and more custody",give procuratorial organs greater discretion,expand the scope of application of relative non-prosecution,strengthen the improvement of supporting mechanisms and systems,realize the efficiency and transparency of administrative punishment,and optimize the misdemeanor governance model.
