摘要
在刑事诉讼中,境外证据的取得与运用是有效打击涉外犯罪的重要前提。受到司法主权、执法权限、程序规定等方面的影响,当前的跨境刑事取证制度缺乏整体性和体系性。为了有效回应跨境取证难问题,需要重视以下三个方面:首先,明确境外证据的范围,并可以通过本国法、区域立法等方式缓解跨境取证中的实践难题;其次,在坚持司法协助取证的基础上,探索构建一种开放性、多元化、协同型的跨境刑事取证体系;再次,联动调整刑法、刑事诉讼法和证据法的相关规定,从刑事一体化角度对境外证据“取证难”“审查难”等问题作出回应。
In criminal proceedings,the collection and utilization of cross-border evidence is a crucial prerequisite for effectively combating foreign-related crimes.However,due to the constraints stemming from judicial sovereignty,law enforcement authority,and procedural rules,the current cross-border evidence collection system lacks coherence and systematic structure.To effectively address the challenges of cross-border evidence collection,attention should be given in the following three aspects:First,the scope of cross-border evidence should be clarified,and the practical difficulties in cross-border evidence collection shall be alleviated through domestic law,regional laws,and other means.Second,while upholding the principle of mutual judicial assistance in cross-border evidence collection,it is necessary to develop an open,diversified,and collaborative system of cross-border criminal evidence collection.Third,a coordinated adjustment of relevant provisions in Criminal Law,Criminal Procedure Law,and Evidence Law is needed,so as to address the difficulties in the collection and scrutiny of cross-border evidence,from a holistic criminal justice perspective.
