摘要
犯罪与被害的异时空性导致起诉条件成就困难,证据类型和证明标准亦导致证据供给能力不足系公安机关协助取证制度确立的事实和证据原因。在网络侮辱、诽谤犯罪依然适用自诉程序的背景下,公安机关协助取证制度从证据法角度,通过激活公安机关协助增强自诉人获取收集证据的能力,有效缓解当前网络暴力治理面临的难题。然而,制度规定的内容过于简单、概括,易造成司法实践困境。因此,秉承增强网络暴力案件中自诉人的证据供给和实现净化网络环境的目标,分别就协助取证行为的协助对象、启动条件、行为性质、取证内容以及当事人的权利救济等方面作进一步完善。
The fact that crimes and victimization occur in different spatial and temporal contexts creates barriers to meeting prosecution conditions,while evidential types and standards of proof further lead to plaintiffs'insufficient capacity in evidence supply.These constitute the factual and evidential reasons for establishing the system of evidence-obtaining assistance by public security authorities.Against the background where crimes of online insult and defamation still follow procedures of private prosecution,this system,from the perspective of evidence law,can activate public security authorities'capacity in assisting private prosecutors to procure evidence,thereby effectively mitigating current challenges in combating cyber violence.Nevertheless,the system's overly simplistic and generalized provisions may create operational obstacles in judicial practice.Aligned with the dual objectives of enhancing private prosecutors'evidential capacity in cyber violence cases and purifying the cyberspace,this study proposes substantive improvements to the following aspects of evidence-obtaining assistance:assistance recipients,conditions for initiating assistance,nature of the assistance,content of evidence obtaining,and the rights and remedies available to the involved parties.
