摘要
在数字经济背景下,数据成为重要的竞争资源,数据的互联互通乃是企业创新发展的内在要求。当数据的缺失阻碍了市场竞争时,数据的强制开放成为摆脱数据困境的首要选择。从数字经济背景下关键设施原则适用的可行分析中可以发现,关键设施原则契合数据开放的现实需求,且数据开放共享具有现实可行性,关键设施原则的认定要件具有可操作性。因此,在现有竞争法规框架下,适用关键设施原则具有合理性,能够有效解决数据封锁带来的竞争损害。在数字经济背景下适用关键设施原则应当从以下三个方面展开:一是增加关键设施原则认定要件的相关规定,为其适用提供规范依据;二是明确关键设施认定要件,从规则层面实现制度适用的可操作性;三是对于关键设施原则适用中的隐私保护和对价确立问题给予充分考虑,坚持个案分析原则,立足于行业发展整体目标,平衡公共利益与创新发展之间的矛盾。
In the context of the digital economy,data has become an important competitive resource,and the interconnection of data has become an intrinsic requirement for the innovative development of enterprises.When the lack of data hinders market competition,the mandatory opening of data becomes the first choice to crack the data dilemma.From the feasible analysis of the application of the principle of essential facilities in the context of digital economy,it can be found that the principle of essential facilities fits the real demand for data openness,and the open sharing of data has the possibility of reality,and the determination of the key elements of the principle of essential facilities is operable.Therefore,under the framework of the existing competition law,the application of the essential facilities principle is reasonable and can effectively solve the competition damage caused by data blocking.The application of essential facilities principle in the context of the digital economy should be carried out in three aspects:The first is to increase the relevant provisions of the essential facilities principle to provide a normative basis for its application.The second is to clarify the elements for the determination of essential facilities,so as to realize the operability of the application of the system at the rule level.The third is to give full consideration to privacy protection and the establishment of consideration in the application of essential facilities principle,adhere to the principle of case-by-case analysis,and balance the contradiction between public interest and innovative development based on the overall goal of industry development.
