摘要
本文从数据价值链及其数据多用途性两个角度来探讨数据集中问题,揭示数据反垄断寓意。数据价值链每个环节都面临各种进入壁垒且相互关联,需要从数据价值链视角审视进入壁垒及其影响。无论是从数据多用途特性角度还是从宏观笼统粗放的角度,都不能推断出数据集中的反竞争性论断。大数据(和算法)的竞争定性需要看数据的具体用途和特定的行业特性。在充分审视数据价值链、明确数据用途及其相关技术细节之前,切记武断地认定数据垄断,仍需秉持包容审慎原则。
s:This paper discusses the concentration of big data from the perspective of data value chain and its data versatility,and reveals the implication of data antitrust.In each stages of given data value chain various entry barriers exist and are interrelated.The anti-competitive argument of data monopoly cannot be inferred from the perspective of data multi-purpose characteristic or from the perspective of macrogenerality.The competitive characterization of big data(and algorithms)needs to be based on the specific purpose of digital data and industry characteristics.The principle of inclusive prudence still needs to be adhered to until data value chain is considered and with sufficient clarity on the purpose of data usage and technical details involved.
