摘要
“数据垄断”是平台经济反垄断的重要争议问题之一。在数字经济中,数据既是资源也是资产,数据的经济属性说明原始数据通常并不会产生“数据垄断”问题,但在数据采集与挖掘利用中,数据持有人可能会实施各种基于大数据的反竞争行为,扭曲市场竞争和阻碍创新,因而“数据垄断”行为应成为反垄断的重点。反“数据垄断”政策应构建以反垄断法为核心的多法协同体制,合理权衡竞争、隐私和创新目标,将数据、算法、平台作为政策重点,实施分类治理并注重市场化数据共享机制的作用。反“数据垄断”政策的核心是确保原始数据的开放接入,为此可实施个人数据可携带权、鼓励消费者授权的批量数据接入、特定情况下的强制性数据接入、互操作性政策等反垄断监管政策。
Data-opolies is the hottest debated issue on platform antimonopoly theory and polices. In the digital economy, data is the core factor and strategic capital. The economic nature of data shows that raw data usually does not cause the problem of “data monopoly”, but in data collection, mining and utilization, data holders may implement various anti-competitive behaviors based on big data, distort market competition and hinder innovation Therefore, the behavior of “data monopoly” should become the focus of anti-monopoly. The anti-“data monopoly” policy should build a multi-law synergy system with the anti-monopoly law as the core, reasonably balance competition, privacy and innovation goals, focus on “data, algorithms, and platforms”, implement classified governance, and focus on the role of market-based data sharing mechanisms. The core of the anti-“data monopoly” policy is to ensure open access to raw data through the implementation of the right to personal data portability, encouragement of consumer-authorized bulk data access, mandatory data access under specific circumstances, and interoperability policies can be implemented.
