摘要
数字商务企业大量过度收集用户隐私数据并且频繁出现隐私数据泄露事件,使个人隐私数据保护成为社会公众和各国政策制定者普遍关注的热点问题。在数据成为数字经济第一生产要素的背景下,个人隐私保护不仅涉及个人隐私权保护问题,也涉及数据要素开发利用问题。政府隐私保护政策制定需要有效平衡个人隐私权保护与促进数字经济创新发展的关系。为此,本文主要对隐私保护的经济学理论研究进行综述,对“隐私悖论”与市场失灵、个人隐私数据的产权配置、隐私保护监管体制与监管政策等问题的理论研究进行总结,从而提供基于效率的隐私保护经济学观点,有助于制定更加科学的数据隐私保护政策,实现个人隐私保护和数字经济创新发展的平衡。
The excessive collection of personal data and the frequent occurrence of privacy leakage events has made privacy protection a heat topic among the public and the policy makers.Under the background that digital economic data has become one of the most important factors of production,privacy protection is not only a problem of protecting privacy as a basic human right,but it also relates to the exploitation of data as a factor.The formulation of governmental privacy protection policy should effectively balance personal privacy rights protection and the innovative progress of digital economy.Therefore,this paper mainly reviews the economic theory of privacy protection,summarizes major principles such as"privacy paradox"which is the policy premise of privacy protection policy,market failure,together with property right allocation of personal privacy data,privacy protection regulation system and regulatory policy,so as to provide an efficiency based economic view about privacy protection,which is helpful to make a more scientific data privacy protection policy.
