摘要
个人信息区分的私法保护目的在于实现精准保护。按敏感程度以及对人身安全、财产价值的威胁程度不同,个人信息可以区分为敏感信息与一般信息。个人信息的区分在精准立法、隐私权保护以及信息合理流通等方面都有重要的价值。个人信息的区分在立法模式上有列举式、情境考量式以及目的考量式,但都存在一定的局限性,应从实然和应然的角度确定具体认定标准。个人信息区分的实然标准是损害结果发生的概率,应然角度则是对“敏感性”的考量。个人敏感信息对信息主体的隐私有重大影响,应该构建事前的保护机制。个人一般信息的保护则可以通过事后侵权责任承担,填补信息主体的损失。
The private law protection of the personal identity information aims to protect an individual precisely.Personal information can be divided into sensitive information and general information,depending on the degree of sensitivity and the threat to personal safety and property values.The differentiation of personal information is of great value for precise legislation,privacy protection,and reasonable information circulation.In terms of legislative models,there are enumerative,contextual,and purpose-determining models for differentiating personal information,but they all have certain limitations,and specific criteria should be determined from the perspective of what is real and what should be the case.The criteria for distinguishing personal information take into account the probability of potential damage wherein the degree of sensitivity is considered.Sensitive personal information has a significant impact on the privacy of the information subject,and proactive protection mechanisms should be established.The protection of general personal information,on the other hand,allows compensation to be made for the loss on the part of the data subject by accounting for the responsibility of the data infringement after it occurs.
