摘要
国际法话语权作为国际话语权谱系的重要组成部分,在国际社会建制、改制和创制过程中发挥着关键性作用。囿于在国际社会建制时,中国等发展中国家错失对国际法"初始"话语权构建之机遇,使其推动全球治理体系变革时遭遇多重阻碍,究其实质,国际法话语权有其生成的基本要素和逻辑。面对逆全球化态势集中升温和全球疫情蔓延对人类生存和发展带来的巨大挑战,使全球治理体系面临变革之必要。中国需进一步增强国际法话语权构建的主体意识、全面积累话语资源、创新话语内容和丰富其多样性,以及打通话语路径,实现各话语要素的优化配置以提升在全球治理体系中的国际法话语权,为促进国际法的发展和建立国际政治经济新秩序发出中国之声。
As an important part of the family of international discourse power,the discourse power of international law plays a key role in the establish,reform and creation of the international systems.Restricted by the institutional framework of the international community,China and other developing countries missed the opportunity to construct the"initial"discourse power of international law,which made them encounter multiple obstacles in promoting the reform of the global governance system.In essence,the discourse power of international law has its basic elements and logic.In the face of the anti-globalization situation and the global epidemic spread,it brings great challenges to human survival and development,which makes the global governance system face the necessary changes.China needs to further strengthen the subject consciousness,comprehensively accumulate discourse resources,innovate discourse content and enrich its diversity in order to enhance its discourse power in the global governance system,so as to promote the development of international law and establish a new international political and economic order with voice of China.
