摘要
以蓝色伙伴关系为依托并以蓝色经济为投资场域的蓝色投资不仅是国际投资增长的新引擎、全球经济发展与合作的新高地、伙伴关系构建与拓展的新平台,还是各国参与全球海洋治理的新通道,具有丰富的战略意涵,其可持续和高质量发展已经成为重要的战略议题与国际共识。鉴于蓝色投资所涉法律问题的特殊性以及国际投资法在蓝色经济领域中的可适用性,从国际投资法层面出发为蓝色投资的准入、保护和规制提供的可行性方案是切实有效促进蓝色投资发展的重要路径。作为蓝色投资活动的积极参与者,我国不仅能够从国际投资法层面做出努力,还应当依托“海洋命运共同体”理念、“全球发展倡议”“海洋可持续发展”目标以及全球海洋治理改革方案推动蓝色投资实现高质量发展。
Blue investment,anchored in blue partnerships and operating within the blue economy as its investment domain,serves not only as a new engine for international investment growth,a strategic frontier for global economic development and cooperation,and a platform for forging and expanding partnerships,but also as a critical channel for nations to engage in global ocean governance.Its strategic implications are multifaceted,and the pursuit of its sustainable and high-quality development has emerged as a pivotal strategic agenda and international consensus.Given the unique legal challenges inherent in blue investment and the applicability of international investment law in blue economy,developing viable solutions at the level of international investment law,including pertaining to investment access,protection and regulation,constitutes a pragmatic pathway to effectively advance blue investment.As an active participant in blue investment initiatives,China should not only contribute to legal innovations within international investment law but also leverage the“Maritime Community with a Shared Future”vision,the“Global Development Initiative”,the goal of“sustainable ocean development”and proposals for global ocean governance reform to propel high-quality development of blue investment.
