摘要
中国式生态安全观是中国共产党对新时代国家安全和生态文明建设进行深刻理论把握而形成的生态安全领域的思想观念。党的底线思维是中国式生态安全观的认知基础,在全面依法治国的战略下,中国式生态安全观的实践进路应体现底线思维与法治思维的统一,不断推进从政治话语到法律制度的全面转化。中国式生态安全观的法治保障和制度建设应以实现人与自然和谐共生的现代化为价值目标,通过生态保护红线制度确定生态安全的边界,完善生态安全风险预防机制,在立法和法律实施层面形成多方协同的法治格局,根据“明确边界-防患未然-严守底线”的思路落实底线思维在生态安全法治建设上的实践新要求。
The Chinese-style concept of ecological security is an ideology in the field of ecological security formed by the Communist Party of China(CPC)as a result of its profound theoretical reflection on national security and the construction of ecological civilization in the new era.The bottom-line thinking of the CPC is the cognitive foundation of the Chinese-style concept of ecological security,and in the context of ruling the country according to the law in a comprehensive manner,the transformation from political discourse to the legal system is the realization path of the Chinese-style concept of ecological security,so as to embody the unity of the bottom-line thinking and the thinking of the rule of law.The rule of law guarantee of Chinese-style ecological security concept should realize the modernization of harmonious coexistence between human beings and nature as the value goal,determine the boundary of ecological security through the ecological protection red line system,improve the ecological security risk prevention mechanism,and form a multi-party synergistic rule of law pattern at the legislative and legal implementation levels.The legal system should be constructed on the basis of the principle of"clear boundaries,preventive measures and strict compliance with the bottom line",so as to realize the practical requirements of bottom-line thinking in the rule of law on ecological security.
