摘要
生态文明建设是中华民族永续发展的千年大计。保护水产资源是生态文明建设的重要方面,但层出不穷的非法捕捞现象对水产资源和生态环境的可持续发展产生了较为负面的影响,也给生态文明建设带来了严峻的挑战。本研究在阐述非法捕捞水产品行为概况的基础上;梳理非法捕捞水产品行为的相关法律规定;分析当前非法捕捞行为的处罚存在的问题及原因。提出加大行政执法力度,提高渔业资源保护效果、执法效率;完善刑事责任相关规定,依法严惩非法捕捞水产品犯罪行为;加强多方协调配合,实现行政执法与刑事司法有机衔接;提升公众法治素养,筑牢生态文明建设基础等对策建议。
The construction of ecological civilization is a long-term strategy for the sustainable development of the Chinese nation.Protecting aquatic resources is an important part of ecological civilization construction.Meanwhile,endless illegal fishing places a negative impact on the sustainable development of aquatic resources and ecological environment,and also brings severe challenges to the construction of ecological civilization.On the basis of summarize the general situation of illegal fishing of aquatic products,this study sorts out the relevant laws and regulations,and analyzes the problems exist in current punishment of illegal fishing,as well as related reason.The research puts forward the following countermeasures and suggestions:strengthen the administrative law enforcement,improve the law enforcement effect of fishery resources protection;perfect relevant provisions on criminal responsibility,and severely punish the illegal fishing of aquatic products according to law;strengthen multi-party coordination and cooperation to achieve effective connection between administrative law enforcement and criminal justice;improve public legal awareness and build a solid foundation for ecological civilization construction et al.
