摘要
数据可携带权首创于欧盟,以数据主体拥有数据控制权为基点,实现数据控制者之间无障碍传输数据。对数据可携带权进行解构后,从保障个人信息自决权以及促进良善社会发展两个层面对权利证成,以及分析域外国家模式的有益参考,数据可携带权在当前数字经济时代下,具有普遍适用的必要性。但是这一新兴权利在适用过程中面临权利属性不明、义务内容边界不清、侵犯第三方权益的窘境。对此,确定权利属性、明晰义务内容边界以及在场景化下对侵犯不同第三方权益作出相应的规制,实现数据主体、数据控制者之间利益的平衡,以期数据可携带权在我国更好地落地。
The right to data portability,first created in the European Union,is based on the right of data subjects to control data,and realizes the unobstructed transmission of data between data controllers.After deconstructing the right to data portability,proving the right from the levels of safeguarding the right to self-determination of personal information and promoting the development of a benign society,and analyzing the useful references to the models of extra-territorial countries,it is necessary to apply the right to data portability universally in the current digital economy era.However,in the process of applying this new right,there are several dilemmas,including unclear attributes of the right,unclear boundaries of the obligations,and infringement of the rights and interests of third parties.Thus,from this aspect,it is important to determine the attributes of the right,clarify the boundaries of the obligations,and regulate the infringement of the rights and interests of different third parties under different scenarios,so as to realize the balance of interests between the data subjects and the data controllers,promoting better implementation of the right to data portability in China.
