摘要
国际调解院香港筹备办公室于2023年2月16日成立,引起各国以及国内外学者广泛关注。国际调解院的建立具有鲜明的时代背景:一方面,世界时局动荡加剧,全球治理赤字严重;另一方面中国综合国力增强,实现历史性跃迁。在这种大环境下,中国以习近平外交思想为指导,遵循联合国宪章,对国际争端解决进行反思性回应和建设性参与,积极提高自身作为国际秩序主体的参与度,主动承担解决国际法治发展难题、提供国际治理中公共产品供给等国际责任,以国际调解院的建立助力国际治理体系重构。各国应在包容开放、共商共建的基础上多向度立体构建国际调解院,可以通过“一带一路”倡议和数字赋能加以辅助,力求实现能给各国同时带来效益的变革。
The establishment of the International Court of Mediation has a distinct background of the times.On the one hand,the world situation is becoming more turbulent,and the global governance deficit is serious.On the other hand,China's comprehensive national strength is enhanced,and a historic leap has been achieved.In this environment,China assist the reconstruction of the international governance system with the establishment of the International Court of Mediation.All countries should build the International Court of Mediation on the basis of inclusiveness,openness,joint consultation and joint construction.
