摘要
法律适用统一事关公正司法长效机制建设的成败,数字时代的新型案件给法律适用带来了挑战,需要最高人民法院通过及时发布权威案例以促进法律适用的统一。在司法实践中,指导性案例等制度定位不清晰、类案检索等实体应用不健全等法律适用不统一问题,损害了司法公信力。因此,构建立足于解决新型疑难案件法律适用问题的中国式判例制度将成为一种抉择。建设中国式判例制度将有助于促进权责配置改革与激励体制建设,发挥司法发展与人民司法需求间的矛盾调节器作用,建设实现路径包括:明确判例制度的法源效力、加强判例制度与制定法适用的程序性衔接。
The unity of legal application is closely related to the success or failure of the long-term mechanism construction of fair justice.The new cases in the digital era have brought challenges to legal application,and the Supreme People’s Court needs to promote the unity of legal application by timely issuing authoritative cases.In judicial practice,inconsistent legal application of unclear positioning of guiding cases and other systems,as well as the inadequate application of entities such as case retrieval,have resulted in undermined judicial credibility.Therefore,building a Chinese style precedent system based on solving legal application issues in new difficult cases will become a choice.The construction of a Chinese style precedent system will help promote the reform of power and responsibility allocation and the construction of incentive systems,and play the role of a contradiction regulator between judicial development and people’s judicial needs.The implementation path of the construction includes:clarifying the legal effectiveness of the precedent system,strengthening the procedural connection of the application between the precedent system and the statutory laws.
