摘要
大数据时代,未成年学生个人信息大量受到侵害,暴露出当前刑法在未成年学生个人信息保护方面存在刑事责任不明、与其他部门法以及监管机制衔接不畅等问题。有必要在刑法领域明确对未成年人个人信息的分类保护,在《中华人民共和国刑法》第二百五十三条之一中,将侵犯未满14周岁未成年人个人信息设置为“情节特别严重”的情形之一,将侵犯已满14周岁未成年人个人信息设置为“情节严重”的情形之一,实现对未成年学生个人信息的刑事立法保护。同时加强“刑民”“刑行”衔接,推动网络信息、监督、教育等部门协作,构建起含预防、监管和惩处的刑法规制模式。
In the Big Data Era,the widespread infringement of minor students'personal information has exposed significant deficiencies in the current criminal law framework,particularly regarding the protection of such information.These deficiencies include ambiguous criminal liabilities and poor coordination with departmental laws and other regulatory mechanisms.It is necessary to establish a classification protection system for minor students'personal information within criminal law.Under Article 253-1 of Criminal Law of the People's Republic of China,the infringement of personal information of minor students under 14 years old should be classified as a“particularly serious circumstance”,while that of those aged 14 and above should be considered as a“serious circumstance”,thereby strengthening criminal legislative protection for minor students'personal information.Furthermore,it is essential to strengthen the coordination between criminal,civil and administrative laws,while promoting collaboration among departments responsible for cyber information,supervision and education to establish a comprehensive regulatory framework that incorporates prevention,oversight and punishment.
