摘要
随着数字经济时代的到来,各国围绕数据跨境合规治理展开的利益博弈愈发激烈,增强数字企业数据合规意识、强化数据跨境合规治理已刻不容缓。当前,我国数字企业参与全球数据跨境流动面临内部数据合规管理体系不完善、国内国外合规风险加大、合规激励机制不健全等现实难题,亟待构建法治化治理路径予以纾解。数据跨境合规既是数字企业应当履行的社会责任,也是打造企业核心竞争力、开拓海外市场的重要保障。为此,应坚持规范与发展并重,以企业主动合规为抓手,推动国内立法与加强国际合作并进,在这一过程中需进一步优化合规激励机制,激活企业合规动力,为数字企业数据跨境流动合规治理提供系统化、法治化、常态化的保障机制。
With the advent of the digital economy, the game of interests around data cross-border compliance governance has become more and more intense in various countries, and it is urgent to enhance the awareness of data compliance among digital enterprises and strengthen data cross-border compliance governance. At present, China’s digital enterprises are faced with practical challenges. Internal data compliance management systems are imperfect,compliance risks at home and abroad increase and compliance incentive mechanisms are inadequate. It needs to be solved by building a rule of law governance path. Data cross-border compliance is not only a social responsibility that digital enterprises should fulfill, but also an important guarantee for building their core competitiveness and developing overseas markets. In this regard, we should attach equal importance to regulation and development, take the initiative of enterprises to comply, promote domestic legislation and strengthen international cooperation, further optimize the compliance incentive mechanism in the process, activate the motivation of enterprises to comply, and provide a systematic, legalized and normalized guarantee mechanism for the compliance governance of data crossborder flow of digital enterprises.
