A Basic Constitutional Study on Consolidating the Sense of Community for Chinese Nation

摘要《宪法》为在中华民族多元一体格局下推进民族关系治理法治化提供了根本的价值遵循、原则约束和规则保障,全面贯彻实施宪法的相关规定,不仅是在宪制的约束下将民族关系治理纳入法治轨道的根本前提,也是通过法治方式促进各民族交往交流交融,引导各族人民铸牢中华民族共同体意识的关键环节。实践中对宪法有关民族关系治理的价值、原则和规则的规定缺乏精准解读,是制约宪法有关民族关系治理规定全面实施的根本因素。为推进宪法的全面实施,当前亟待加强对宪法有关规定的解释,强化对调整民族关系的法律规范体系的清理和审查,提升民族关系治理法治化理论研究的针对性和有效性,消除宪法有关规定不甚明确、权威性缺乏及法治能力不强等因素对通过法治方式促进各民族交往交流交融的制约,由此才能为充分发挥宪法有关民族关系治理规定的引导、规范和约束功能,夯实铸牢中华民族共同体意识的法治之基,奠定坚实的宪制基础。 The Constitution provides fundamental values, principles and institutional safeguards for promoting the rule of law in the governance of ethnic relations in the context of the pluralistic unity of the Chinese nation. Fully implementing the relevant provisions of the Constitution is not only a fundamental prerequisite for bringing the governance of ethnic relations into the orbit of the rule of law under constitutional constraints, but also a way to promote interaction, exchange and integration among ethnic groups through the rule of law and to guide people of all ethnic groups to forge a firm sense of the community for Chinese Nation. It is also a key link in the process of forging a sense of community among the Chinese people. The lack of precise interpretation of the constitutional provisions on the values, principles and institutions about ethnic relations governance in practice is a fundamental factor which limits the full implementation of the constitutional provisions on ethnic relations governance. There is an urgent need to strengthen the revision or interpretation of the relevant provisions of the Constitution, to further disentangle and review the normative system of ethnic law, to improve the relevance and effectiveness of theoretical research on ethnic rule of law, and to eliminate the restrictive factors which hinder the promotion of interaction, exchange and integration of ethnic groups through the rule of law and which are imposed by the lack of clarity and authority and the weak capacity of the rule of law. In this way, a solid constitutional foundation can be laid for giving full play to the guiding, regulating and restraining functions of constitutional provisions on the governance of ethnic relations, and fortifying the foundation of the rule of law for casting a firm sense of community among the Chinese people.
