宪法规范视域下国家意识、公民意识、法治意识的法理规约解析

Analysis of the Social Norms and Legal Implications of National Consciousness,Civic Consciousness,and Consciousness of the Rule of Law from the Perspective of Constitutional Norms

摘要增强国家意识、公民意识、法治意识是铸牢中华民族共同体意识工程的重要内容和落脚点。“三个意识”相辅相成,统合于国家共同体。厘清增强“三个意识”的相应法理依据和关系逻辑,应立足宪法的文本规范与内在法理。宪法是增强“三个意识”的根本法治保障。增强国家意识,将当代中华民族规约为象征国家文明主体和拥有国家主权的人们共同体,国家统一与民族团结基础上的中华民族伟大复兴与现代国家法治建设并行;增强公民意识,将中华民族成员规约为公民、人民、国民的内在统一,中国特色社会主义新型民族关系得以在全过程人民民主的法治实践中建构;增强法治意识,将多民族国家建设中的主要民族议题规约为党领导下的民族事务治理和民族区域自治的法治化,不同的责任与义务主体要践行社会主义核心价值与法治公平正义价值。 Enhancing national consciousness,civic consciousness,and consciousness of the rule of law is an important content and strategic foothold in fostering the consciousness of community for the Chinese nation.National consciousness,civic consciousness,and consciousness of the rule of law are interdependent and mutually reinforcing,which are integrated into the national community.Clarifying the corresponding legal basis and logical relationship should be based on the normative text and internal legal principles of the Constitution.The Constitution is the fundamental legal basis for enhancing the above“three consciousnesses”.The relevant implications of enhancing national consciousness are manifested as that the Chinese nation symbolizes the subject of national civilization and a community of people with national sovereignty,and that the great rejuvenation of the Chinese nation based on national unity and ethnic solidarity is parallel to the construction of the rule of law in modern countries.The relevant implications of enhancing civic consciousness are manifested as that the community for the Chinese Nation is internalization and unity of citizens,people,and nations,and that the new type of socialist ethnic relations with Chinese characteristics can be constructed in the legal practice of whole process people sdemocracy.Enhancing the awareness of the rule of law is manifested as:the main ethnic issues in the construction of a multi-ethnic nation are regulated as the rule of law in the governance of ethnic affairs and regional ethnic autonomy under the leadership of the Communist Party of China,and the different subjects of responsibility and obligation are required to practise the core values of socialism and the values of fairness and justice under the rule of law.
