摘要
智能互联网时代,信息传播的平台化成为显著特征。明确平台责任及治理规则成为智能信息传播治理的关键环节。本文聚焦智能信息传播治理的法律和伦理困境,从治理理念、平台责任设定、平台责任评价等方面分析造成治理困境的原因,探讨平台责任设定的正当性基础、责任属性与边界、平台治理方式变革等重要问题。认为顺应智能传播变革和国家治理现代化要求,应积极探索构建新型平台治理机制:完善责任型平台主导下的多元合作综合治理模式;将平台权力纳入法治轨道,保障用户权利;在多元协商与对话的情况下重构约束平台的不同治理主体间的伦理规范。
The platformization of information communication becomes an obvious feature in an intelligent network age,so for the governance of intelligent information communication,it is a key point to make the platforms'responsibility and governance rules clear.This article focuses on the legal and ethical dilemma of the intelligent information communication governance,analyzing the causes of the governance predicament from the perspectives of how to govern the platforms and how to determine and evaluate the responsibility of the platforms.Then the article deals with some important issues such as the legitimate basis of the platforms'responsibility setting,the properties and borders of their responsi-bility and the transformation of the platforms'governance model.The article con-clues that in order to adapt to the intelligent communication transformation and the modernization of state governance,we should work hard to construct a new mechanism of the platform governace,to advance the cooperation of plural sub-jectives to establish a comprehensive governance mode under the circumstance of responsible platforms.Furthermore,we should bring the platforms'power into the track of rule of law and protect the users'rights.And lastly,we should also reconstruct the ethical rules such as restraining the platforms among different governance subjects under the circumstance of plural consultation and dialogue.
