摘要
媒介技术的发展带来了知识生产及获取方式的变革,短视频的崛起将知识生产场域扩展至短视频平台。短视频平台中知识产消关系变革冲击着传统版权价值体系;知识短视频的众包生产机制加大了版权归属的判定难度;短视频融合形态的复杂性妨碍“合理使用”判定;知识短视频版权保护与知识共享的冲突难解。内生性治理主张自律和他律相结合,尊重市场主体需求的同时融入政府柔性治理,以动态协商方式化解版权保护的核心症结。依据内生性治理,构建版权平台过滤机制,拓展版权运营模式,搭建视频数字版权交易平台等,是知识短视频版权治理的有效对策与路径。
The development of media technology has brought about changes in the way of knowledge production and acquisition,and the rise of short video extends the field of knowledge production to short video platform.The change of the relationship between knowledge production and consumption in the short video platform impacts the traditional copyright value system;the crowdsourcing pro-duction mechanism of knowledge short video increases the difficulty of judging copyright ownership;the complexity of its fusion form hinders the judgment of“fair use”;the conflict between knowledge short video copyright protection and knowledge sharing is difficult to solve.Endogenous governance advocates the com-bination of self-discipline and heteronomy,respecting the needs of market sub-jects while integrating into the flexible governance of the government,and resol-ving the core crux of copyright protection by dynamic negotiation.According to the endogenous governance,constructing the copyright platform filtering mechanism,expanding the copyright operation mode and building the video digital copyright trading platform are effective countermeasures and paths of knowledge short video copyright governance.
