摘要
生产要素市场化配置的不充分和不均衡是我国经济体制改革中的难题。为完善社会主义市场经济体制,建议抓紧建立健全要素市场化配置友好型的七大法治保障体系,包括法律规范体系、企业理性自治体系、行业严格自律体系、行政监管体系、多元化争议解决体系、协同共治体系与第三方学术独立评价体系。市场主体是法律制度的用户,也是法律制度的设计者。建议完善五大要素市场立法体系。企业理性自治是要素配置市场化的压舱石。企业应秉持“一心、二维、三品、四商、五严、六实”的法律与伦理操守。自律规则应严于法律规则。行业自律的重点是预防诚信株连,铸造行业公信。市场失灵时,监管者不应失灵。“放管服”三个字一个都不能少。五大监管职责的落实、五大服务的提供都有赖于法治政府建设以及亲清新型政商关系的构建。
Insufficiency and imbalance in the market-oriented allocation of production factors are the hardest nuts to crack in the reform of economic system in China.To improve socialist market economy,it is advisable to promptly establish and boost seven legal systems that are friendly to market-oriented allocation of factors:legal regulation,rationality of company autonomy,strict industrial self-discipline,administrative supervision,multiple dispute resolutions,collaborative governance and the third party’s independent academic evaluation.Market subjects are users and designers of these legal systems.It is suggested to improve five legal systems of factor markets.Companies’Rational autonomy is the cornerstone of the market-oriented allocation of factors.Enterprises should follow such legal and ethnic principles as gratitude for customers,rational pursuit of profits,quality enhancement,strict standards and maintaining customers’rights.The principle of self-discipline should be stricter than legal rules.The key to industrial selfdiscipline is to form industrial credibility and prevent integrity incrimination.The supervisor should work properly when the market is out of order.It is indispensable to“streamline administration,innovate supervision and optimize service”.The practice of five regulatory responsibilities and the provision of five services depend on the development of a government under rule of law and a new type of close and pure government-business relationship.
