摘要
合宪性审查与宪法监督及宪法实施密切相关,近年来中国共产党对合宪性审查有了更清晰明确的认知,力图在今后大力推进合宪性审查工作,以捍卫宪法尊严、维护宪法权威。构建合宪性审查机制,需嵌入中国话语,体现制度自信和理论自信,应该始终坚持党的领导,并在人民代表大会制度框架内有序实施,秉持政治问题不审查的原则。合宪性审查工作要想取得实质突破,应该设立专门的审查机构,明晰与"中央全面依法治国领导小组"之间的关系,明确启动合宪性审查的主体资格,厘清合宪性审查的对象范围,健全合宪性审查的基本程序以及完善宪法解释程序机制。唯有如此,才能从理论指导和制度实践两个维度,推动合宪性审查工作逐步走向深入。
In recent years, the party has a clearer and clearer cognition of constitutionality censor- ship, trying to vigorously promote constitutionality review in the future in order to safeguard the dignity of the Constitution and maintain the authority of the constitution. To build constitutionality review mech- anism, we need to embed Chinese discourse, embody institutional self- confidence and theoretical self -confidence. We should always adhere to the leadership of the party and implement it orderly within the framework of the people＇ s Congress system, and uphold the principle of non censorship of political issues. The review of constitutionality work to achieve substantial breakthroughs should set up a special review body, clarify its relationship with the ＂rule of law＂ leading group, make constitutional review qualification clearer, clarify the object of review of constitutionality and the scope of the complete review of the constitutionality of the program and perfect constitution interpretation procedure mechanism con- struction.
