网络人权的理论和制度:国际经验及对我国的启示 被引量:10

Theory and Institution of Human Rights on Internet: International Experience and its Enlightenment to China

摘要 网络人权是线下的传统人权在网络空间的延伸,是一系列人权的集合。国际主流观点认为网络人权应当受到一定限制,国际社会在限制网络人权时严格遵循三段论原则,有效运用合作规制,在进行网络人权立法时开展人权影响评估。我国应借鉴国际有益经验,对网络人权的限制坚持依法行政原则和比例原则,在互联网监管方面实现四个转变,即从单中心监管到多主体治理的转变,从刚性监管到刚柔并济的转变,从集中整治模式到常态化监管的转变,从重实体、轻程序到树立程序正当理念的转变。本文从立法和监管方面提出了具体建议。 Human Rights on the Internet are the extension of traditional human rights to the cyberspace and the general name of a series of human rights. According to the main viewpoint in the international society, human rights on the Internet shall be subject to some limitations, but the limitations shall follow the syllogism, effectively use regulation through cooperation and carry out human rights Impact Assessment while drafting legislation. The author suggests that learning from the useful international experience, we shall follow the principle of administration according to law and principle of proportionality, realizing four transfers : from the single-center regulation to the governance by multiple bodies, from the rigid regulation to the combination of rigid and soft regulations, from the centralized regulation to the day-to-day law enforcement, from the substance-priority to the due process notion in progress. This paper also makes suggestions from legislative and regulatory aspects.
