摘要
解决比例原则当下在我国法学界尴尬地位的方法之一,是回归到其规范基础的梳理。行政法领域的规范梳理对于推动比例原则的本土发展有重要意义。在实定法和非实定法法源之外,以法释义学概念为基础,有必要区分比例原则的"隐含规范"与"明示规范",从而厘清作为裁判理由和裁判依据之间的关系;以规范功能为标准,有必要区分诫命性规范和适用性规范,从而为比例原则"凭什么适用"和"在哪里适用"提供依据。规范基础为比例原则的司法适用提供正当性基础,并指引着从"行为法规范"到"裁判法规范"适用的逻辑进路。比例原则适用的规范基础梳理,有跨部门借鉴和互补的功能。
One of the ways to solve the embarrassing status of proportionality principle in the legal field is to return to its normative basis.The observationfocusing on administrative law is of great significance.It is necessary to distinguish between the"implied norm"and the"express norm"of proportionality on the basis of the legal dogmatics analysis,so as to clarify the relationship between the reason and the foundation of judgment.On the perspective of function,it is necessary to distinguish"prescriptive norm"from"applicable norm",so as to provide the basis for"by what"and of"where"the principle of proportionality applies.The normative basis provides the legitimate basis for the judicial application of the proportionality principle and guides the logical path from the"norm of behavior rule"to the"norm of judgment rule".The normative basis of proportionality in administrative law has the function of references to the cross-departmental law field.
