摘要
区块链技术的创新为众多领域的繁荣带来了驱动力。与新技术和新应用并行的是新思维和新治理。尽管区块链技术具有去中心化、自由灵活、传输便捷、成本低、效率高、可存证等不胜枚举的优势,但是对技术支持下的信任机制保有合理怀疑,不断完善区块链的治理是必要的。面对区块链治理的难题,应当转变传统严厉监管的治理理念,明确对"去中心化"的驯化是历史的必然趋势同时分辨真伪危机,处理好区块链技术对法律技术、法律范式的冲击,建构完备的区块链服务提供者责任制度。
The innovation of blockchain technology has driven the prosperity of many fields.Parallel to new technologies and applications is new thinking and new governance.Although the blockchain technology has uncountable advantages such as decentralization,freedom and flexibility,convenient transmission,low cost,high efficiency,and possibility of storage,the trust mechanism under technical support should be doubted about,and the constant improvement of the blockchain governance should be necessary.In the face of the problems of blockchain governance,first of all,we should change the traditional strict governance idea.Secondly,it should be clear that the taming of"decentralization"is an inevitable historic trend,and at the same time,the real crisis and the false crisis should be distinguished.Thirdly,the impact of blockchain technology on legal technique and legal paradigm should be properly dealt with.Finally,a complete blockchain service provider responsibility system should be structured and established.
