Study on the Procuratorial System of Dispatching Procurators to Law Enforcement and Case Management Centers of the Public Security Organ——An Exploration on the Chinese Way of Investigation and Supervision

摘要派驻公安机关执法办案管理中心检察机制是检察机关加强侦查监督的地方改革探索。该制度的设立符合幂次分布原理应用,缩小了监督盲区,实现了监督与侦查的同步,有效拓展了线索来源。在该制度运行中,涵育了以人权保护为核心的监督理念,有效缓解了检察官"追诉者"立场与"监督者"身份的角色冲突,推动侦查监督程序运行由依附走向独立。为了适应新时代人民群众对民主法治公平正义安全环境的新需求,我国侦查监督路径应当适时更新。在制度上适当调整检警关系,进一步加强监督的实质性;在程序运行上,摆脱对审查逮捕的依附,推动侦查监督的独立运行;在操作上,落实改革要求,推动重大侦查监督事项案件化办理。 The procuratorial system of dispatching supervision groups to law enforcement and case management centers of public security organs is the reform and exploration of procuratorial organs to strengthen supervision and investigation at local level.The establishment of this system accords with the application of power distribution law.It narrows down the blind area of supervision,synchronizes supervision and investigation,and effectively expands the sources of clues.Moreover,it is operated under the supervision principle of taking the protection of human rights as core.This largely alleviates the conflict between the two roles of procurators as both the prosecutor and the supervisor,and contributes to the independent operation of investigation and supervision procedures.In order to meet people’s new needs for a democratic,fair,just and secure environment under the rule of law in the new era,the way of investigation and supervision in our country should be timely updated.In the aspect of mechanism,the relationship between procurators and police should be properly adjusted to further improve the actual effects of supervision.In procedures,investigation and supervision should get rid of their attachment to review and arrest to realize independent operation.In practical operation,requirements of reform should be implemented,and the major investigation and supervision matters being handled as cases should be further promoted.
